Liability Limitation & Indemnity

Limited liability

Should any liability arise from the actions of Pet Barrier Company or its representatives, and regardless of whether any loss, damage or injury was caused or contributed to by our negligence, that liability will not exceed $97.

Pet Barrier Company, its representatives and its distributors make no assertion or assurance that any of our products is designed to prevent injury or loss, and we are not responsible or liable for injury, loss or damage caused by anyone.

To the fullest extent the law allows, we are not liable to you or to any third party claiming through you for indirect, consequential, special, incidental, punitive or exemplary damages arising out of your use of, or inability to use, a product, including interruptions or delays, whatever the type of claim, even if we have been told the loss was possible. To the fullest extent the law allows, our maximum aggregate liability will not exceed the amount you paid for the goods the liability relates to.

To the fullest extent the law allows, if you are dissatisfied with a product, with the fulfilment of an order, or with any part of this agreement, your sole and exclusive remedy is to stop using the product.

Except in the case of our own wilful misconduct or fraud, you understand and agree that your use of our products is at your sole risk and that, to the extent the law allows, you are solely responsible for damage to you, your property, a third party or their property arising from that use.

We are not responsible for shipping or fulfilment delays, for the cancellation of a transaction, or for a product being unavailable.

Nothing in this section limits any right you have under the consumer law of your state that cannot lawfully be excluded, including rights relating to goods that are faulty or not as described.

Indemnity

The person using a Pet Barrier Company product indemnifies all representatives and distributors of Pet Barrier Company against all claims, lawsuits, legal fees and losses asserted against them and alleged to be caused by that product. This includes claims for contributory liability and subrogation, and extends to third-party beneficiaries of the user.

Our products are not directed at, or intended for distribution to or use by, any person or entity in a jurisdiction where that distribution or use would be contrary to law or regulation, or would subject us, our licensees or our affiliates to a registration requirement in that jurisdiction.
